1. Introduction

Welcome to The Host, operated by Creative Buzz Co., a company incorporated in South Africa under registration number 2020/584902/07. These Terms & Conditions govern your use of our services and websites. By using our services, you agree to comply with these Terms & Conditions. • “Services” refers to the web hosting, domain registration, and related services provided by The Host.
• “Client” refers to any person or entity using the Services provided by The Host.

3. Service Agreement

By using The Host’s Services, you agree to abide by the terms of this agreement. The Services provided include but are not limited to:

• Web hosting and related infrastructure services.
• Domain name registration and management.
• Email hosting and related services.
• Technical support related to the Services provided.

4. Account Registration

To use certain Services, you may need to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. The Host reserves the right to suspend or terminate your account if any information provided during the registration process or thereafter proves to be inaccurate, not current, or incomplete.

5. Payment Terms

Payment for Services is due in advance of the provision of Services. The Host accepts payment via Visa and Mastercard credit cards, Maestro and Visa Electron debit cards, Masterpass, Mobicred, MoreTyme, SnapScan, SCode, and Instant EFT by Payfast. A 50% deposit is required upon confirmation of Services, which is non-refundable once work commences. The remaining balance must be paid upon completion of the Services.

6. Refund and Return Policy

Once work has commenced on a project, the 50% deposit is non-refundable. The Client is liable to pay the entire balance for Services rendered, as energy and time have been invested. Refunds or returns are not applicable to Services that have been completed and delivered in accordance with agreed specifications.

7. Use of Services

You agree not to use the Services for any unlawful or prohibited activities. Prohibited activities include, but are not limited to:

• Violating any applicable laws or regulations.
• Transmitting any harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable material.
• Interfering with or disrupting the integrity or performance of the Services or the data contained therein.
• Attempting to gain unauthorized access to any part of the Services or to any other systems or networks connected to the Services.

8. Intellectual Property

All content and materials available on The Host’s websites, including but not limited to text, graphics, logos, button icons, images, audio clips, data compilations, and software, are the property of The Host or its licensors and are protected by South African and international copyright laws.

9. Limitation of Liability

The Host shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of the Services or with the delay or inability to use the Services, or for any information, products, and services obtained through the Services.

10. Termination

The Host reserves the right to terminate or suspend your access to all or part of the Services at any time, with or without cause, with or without notice, effective immediately.

11. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of South Africa. Any dispute arising under these Terms & Conditions shall be subject to the exclusive jurisdiction of the courts of South Africa.

12. Modifications

The Host reserves the right to revise these Terms & Conditions at any time without prior notice. By using the Services after such changes, you agree to be bound by the revised Terms & Conditions.
